Article 1 – Parties

1.1. Seller

1.2. Buyer

Name/Surname/Title, Address, Telephone and Email details are filled in with the information declared at the time of order. (Hereinafter referred to as the "BUYER".)

Article 2 – Subject

The subject of this agreement is to determine the rights and obligations of the parties regarding the sale and delivery of the digital SaaS service ordered electronically by the BUYER from the SELLER's website, in accordance with the provisions of Law No. 6502 on the Protection of Consumers and the Regulation on Distance Contracts.

Article 3 – Service Information

KobiGPT is a SaaS platform offering AI-powered digital business assistant services. The basic characteristics, scope and price of the service are published on the website. The Platform operates on overseas server infrastructure of Google Cloud Platform and Amazon Web Services under standard subscription plans. The BUYER accepts that the service runs on overseas servers and that their data is transferred abroad in this scope.

Article 4 – Payment Method

  • Payments are made via the secure PayTR payment infrastructure.
  • Visa, MasterCard, Troy, American Express credit/debit cards and Pay with PayTR are accepted.
  • All payment transactions are protected by 256-bit SSL encryption and 3D Secure.
  • Credit card details are not stored on SELLER servers; they are processed via PayTR PCI DSS-compliant infrastructure.

Article 5 – Delivery of the Service

  • Services are entirely digital; no physical product delivery is made.
  • Service access is activated immediately after payment is confirmed.
  • Service access details are sent to the BUYER's registered email address.
  • The service can be used from any device with an internet connection via https://kobigpt.com.

Article 6 – Right of Withdrawal

Pursuant to Article 15 of the Regulation on Distance Contracts, the right of withdrawal cannot be exercised for services performed instantly in electronic form. The BUYER accepts that the right of withdrawal cannot be used after performance of the digital service has begun. A full refund is made if the service cannot be provided at all for technical reasons.

Article 7 – Data Processing and Liability

The BUYER acts as data controller for data uploaded to the Platform under KVKK. The BUYER accepts and undertakes not to upload special categories of personal data (health, biometric, genetic data, criminal convictions, trade union membership, etc.) to the Platform. The BUYER declares that they have fulfilled all obligations under KVKK regarding the personal data they upload.

Article 8 – Disputes

The laws of the Republic of Türkiye apply to disputes arising from this agreement. Consumer Arbitration Committees or Consumer Courts have jurisdiction according to monetary limits announced by the Ministry of Trade of the Republic of Türkiye.
