1. Parties and Definitions

1.1. Service Provider

1.2. Definitions

  • "Platform": KobiGPT AI-powered business assistant services offered via kobigpt.com.
  • "User": A natural or legal person who registers on the Platform and uses the services.
  • "Content": Any data, file, text, image and information uploaded, entered or submitted by the User for processing on the Platform.
  • "LLM": Third-party large language models used by the Platform to deliver AI services.
  • "Special Categories of Personal Data": Data defined under KVKK Art. 6, including health, biometric, genetic data, criminal convictions, trade union membership, religion, sect, political opinion, sexual life, race and ethnic origin information.

2. Scope of the Service

KobiGPT is a SaaS platform providing AI-powered business assistant services to small and medium-sized enterprises. Services offered via the Platform include AI-assisted text generation, document analysis, business process automation, data analysis and reporting. Under the Enterprise Plan, a Turkey-located server infrastructure option may be offered under a special agreement.

3. Data Processing and Overseas Transfer

Under standard subscription plans, User data is processed and stored in data centres operated by Google Cloud Platform (GCP) and/or Amazon Web Services (AWS). This constitutes transfer of personal data abroad under KVKK. By registering on the Platform, the User declares acceptance of this transfer. For AI processing purposes, data is transmitted to overseas servers of LLM providers.

4. User's Data Controller Responsibilities

THE USER ACCEPTS AND UNDERTAKES NOT TO UPLOAD SPECIAL CATEGORIES OF PERSONAL DATA TO THE PLATFORM. Health data, biometric data, genetic data, criminal convictions, race/ethnic origin, political opinion, religion/sect, trade union membership and data relating to sexual life must not be uploaded.

The User accepts that they act as "data controller" for personal data uploaded to the Platform under KVKK. The Service Provider acts as "data processor" with respect to such data.

5. Other User Obligations

  • Provide accurate and up-to-date information when registering on the Platform
  • Maintain account security; do not share passwords and access credentials with third parties
  • Use the Platform only for lawful purposes
  • Do not upload content that infringes third-party intellectual property rights
  • Do not use the Platform to produce malicious software or for illegal activities

6. Intellectual Property Rights

Intellectual property rights in the Platform, software, design, logo and all components belong to the Service Provider. Rights in content uploaded by the User remain with the User.

7. Service Level and Limitations

The Service Provider does not guarantee uninterrupted operation of the Platform. It cannot be held liable for outages or data loss arising from third-party services. Total liability is limited to the total service fees paid by the User in the last 12 months.

8. Account Suspension and Termination

The Service Provider may suspend or terminate the account in case of breach of contract. Uploading special categories of personal data is considered a serious breach. The User may close their account at any time; data is deleted within 30 days.

9. Governing Law and Disputes

This agreement is subject to the laws of the Republic of Türkiye. Istanbul Courts and Enforcement Offices have jurisdiction for disputes. For consumer transactions, Consumer Arbitration Committees or Consumer Courts have jurisdiction.
